Article 1 – Purpose
These terms and conditions govern sales by Cote-a-cas éditions, 50 rue Bauducheu, 33800 Bordeaux, France, relating to the online sale of collectible items.
Article 2 – Prices
The prices of our products are indicated in euros, all taxes included (VAT and any other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping costs. If an order is placed for a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Cote-a-cas éditions. They will be borne by you and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of origin, are payable in euros. Cote-a-cas éditions reserves the right to change its prices at any time, but the product will be invoiced on the basis of the rate in effect at the time the order is validated and subject to availability. The products remain the property of Cote-a-cas éditions until full payment of the price has been received. Please note: once you physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.

The contractual information is presented in French and will be confirmed at the latest at the time your order is validated. Cote-a-cas éditions reserves the right not to register a payment and not to confirm an order for any reason whatsoever, and in particular in the event of a supply issue or a problem concerning the order received.
Article 4 – Order validation
Any order placed on the website www.cac-editions.com implies acceptance of these General Terms and Conditions. Any order confirmation constitutes your full and unconditional acceptance of these general terms and conditions of sale, without exception or reservation. All data provided and the recorded confirmation shall constitute proof of the transaction. You declare that you are fully aware of this. The order confirmation shall constitute a signature and acceptance of the transactions carried out. A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the email address used for your order confirmation.
Article 5 – Payment
By validating your order, you undertake to pay the indicated price. Payment for your purchases is made by credit card via the secure PayPlug system. Your card will be debited only at the time the order is shipped. In the event of partial deliveries, only the products shipped will be charged.
Article 6 – Withdrawal
In accordance with the provisions of Article L.121-21 of the French Consumer Code, you have a period of 14 days from receipt of your products in which to exercise your right of withdrawal, without having to justify your decision or pay a penalty. Returns must be made in their original, complete condition, including packaging, accessories, and instructions. In this respect, you are liable for any deterioration. Any damage suffered by the product in this context may be such as to invalidate the right of withdrawal. Return shipping costs shall be borne by you. If the right of withdrawal is exercised, Cote-a-cas éditions will reimburse the sums paid within 14 days following notification of your request, using the same payment method as that used for the order. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to: the supply of services fully performed before the end of the withdrawal period and the performance of which began after the consumer’s prior express consent and express waiver of the right of withdrawal; the supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the trader and which may occur during the withdrawal period; the supply of goods made to the consumer’s specifications or clearly personalized; the supply of goods liable to deteriorate or expire rapidly; the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection; the supply of goods which, after delivery and by their nature, have become inseparably mixed with other items; the supply of alcoholic beverages whose delivery is deferred for more than thirty days and whose agreed value at the time of conclusion of the contract depends on fluctuations in the market beyond the trader’s control; the supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery; the supply of a newspaper, periodical or magazine, except for subscription contracts for these publications; transactions concluded at a public auction; the supply of digital content not supplied on a tangible medium, where performance began after the consumer’s prior express consent and express waiver of the right of withdrawal. Article 7 – Availability Our products are offered while visible on the website www.cac-editions.com and within the limits of available stock. For products not held in stock, our offers are valid subject to availability from our suppliers. If a product is unavailable after your order has been placed, we will inform you by email. Your order will be automatically cancelled and no bank debit will be made. In addition, the website www.cac-editions.com is not intended to sell products in large quantities. Consequently, Cote-a-cas éditions reserves the right to refuse orders for identical items.
Article 7 – Delivery
Products are delivered to the delivery address indicated during the ordering process, within the time stated on the order validation page. In the event of a shipping delay, you will be notified by email of any possible impact on the delivery time indicated to you. In accordance with legal provisions, in the event of late delivery, you have the option of cancelling the order under the conditions set out in Article L.138-2 of the French Consumer Code. If you receive the product in the meantime, we will refund it and the delivery costs under the conditions of Article L.138-3 of the French Consumer Code. In the case of delivery by carrier, Cote-a-cas éditions cannot be held responsible for a delivery delay caused solely by the customer’s unavailability after several appointment proposals.
Article 8 – Warranty
All our products benefit from the legal guarantee of conformity and the warranty against hidden defects, as provided for by Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a sold product, it may be returned, exchanged, or refunded. All claims, requests for exchange, or refund requests must be made by email within 30 days of delivery. Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed on the basis of the amount invoiced, and return costs will be reimbursed upon presentation of supporting documents. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
Article 9 – Liability
The products offered comply with current French legislation. Cote-a-cas éditions cannot be held liable for failure to comply with the legislation of the country in which the product is delivered. It is your responsibility to check with local authorities the possibilities for importing or using the products or services you intend to order. Furthermore, Cote-a-cas éditions cannot be held liable for damage resulting from improper use of the purchased product. Finally, Cote-a-cas éditions cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular service interruptions, external intrusion, or the presence of computer viruses.
Article 10 – Applicable law in the event of disputes
The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Article 11 – Intellectual property
All elements of the website www.cac-editions.com are and remain the intellectual and exclusive property of Cote-a-cas éditions. No one is authorized to reproduce, exploit, redistribute, or use in any manner whatsoever, even in part, any element of the website, whether software, visual, or sound. Any simple link or hyperlink is strictly prohibited without the express written consent of Cote-a-cas éditions.
Article 12 – Personal data
Cote-a-cas éditions reserves the right to collect personal information and personal data concerning you. These are necessary for managing your order, as well as for improving the services and information we send you. Article 13 – Archiving / Evidence
Cote-a-cas éditions will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code. The computerized records of Cote-a-cas éditions shall be regarded by all concerned parties as proof of communications, orders, payments, and transactions between the parties.
